The scope of legal regulation is considered, which covers the actual detention of a suspect, that is, a preliminary compulsory action that allows for the possibility of further criminal prosecution of a person who has come to the attention of law enforcement agencies.The conclusion is substantiated that actual detention is neither a criminal procedural, nor an administrative-legal, nor any other sectoral measure. Such detention must be the object of autonomous public legal regulation and provided for by a separate federal law.
