The article is devoted to the study of the criteria established in the practice of constitutional proceedings for the proportionality of restrictions on the right to freedom and personal inviolability, the right to privacy of foreign citizens and stateless persons. The constitutional and legal aspect of this issue is to establish a balance between the rights of an individual and the right of the state to restrict her stay in Russia. Based on the analysis of the decisions of the Constitutional Court of the Russian Federation and the legislation, the author emphasizes the need to ensure a balance of private and public interests when limiting personal constitutional rights, suggests a direction for improving the current system of regulatory regulation in the area under study in order to increase the level of legal guarantees for the implementation of the category of rights under study.
