The purpose of this study is to conduct a comparative legal analysis of the early release of convicts from penitentiary institutions under the laws of the United States of America and the Russian Federation.The methodological basis of the study was the dialectical method of cognition; when studying legal acts, methods of analysis and synthesis were used. In order to identify the features and differences of legal systems, the comparative legal and formal legal methods were used. The author describes in detail the three main forms of early release in the United States, and dwells separately on a special type - release on compassionate grounds. The author comes to the conclusion that due to the difference in the legal systems of the United States and Russia, the implementation of the institution of early release may differ significantly, however, some features can be borrowed and applied in domestic legislation.
