The terms “model” and “modeling” are actively used in dissertation legal works, but their essence is not explored or disclosed. There is no established understanding of these terms. Purpose of the work: to explore the concept of a theoretical model of the phenomenon of reality and propose a methodology for its use in legal scientific works. Methods. The literature on legal theory and scientific methodology is analyzed to identify the concept of a theoretical model, generalizations and conclusions are made, the phenomenological method is applied, and conclusions about the theoretical model are given. The article consists of an introduction, sections “The concept of a theoretical model”, “Functions of theoretical modeling in scientific research”, “Requirements for the validity and truth of a theoretical model”, “Methodology for using theoretical modeling of reality in legal scientific works” and a conclusion. Results. A methodology has been developed for using a theoretical model of the phenomenon of reality in legal scientific research.
