| The article describes the concept and the legal nature of such forms of compensation for harm caused by crime as court-initiated recovering compensation, restitution under criminal procedure and voluntary compensation for harm. It focuses on the most controversial aspects of the implementation of these forms of compensation for harm in the criminal process, taking into account their relationship with actionable protection of rights. A number of proposals aimed at improving the existing legislation and law enforcement procedure are made. |
