The article offers an analysis of the existing Russian legislation and legal science on limited access information flow and confidentiality of information. There are different approaches in Russian legislation and legal science to the notion of a secret and to how it is used in legal texts. The adoption in 2006 of a new law on information dramatically changed the existing system of information with limited access, while leaving many issues unresolved. The legislator introduced a new term «confidentiality» of information instead of «confidential information» that complicated the understanding and interpretation of the existing rules of law. These problems make legal scholars and practitioners return repeatedly to the need of establishing a common system and a unified approach to the understanding of the term «secret» as well as to the elements of its legal regime, including the confidentiality of information.
