Abstract
The aim of this article is to define the legal nature and the evidentiary value of «verification actions» envisaged at the stage of initiation of a criminal case. The philosophical basis for the study is provided by the method of dialectical materialism, whereby all phenomena and the relations between them are studied in their entirety. We have also used the methods of synthesis and analysis, induction and deduction, as well as special methods of research in the field of legal science. Main results are as follows: the article highlights the main problems related to verification actions: a) determination of their legal nature; b) understanding whether the list of verifying actions specified in the criminal procedure law is exhaustive; c) establishing the evidentiary value of the verification actions. The positions of different scholars with regard to these problems are analyzed. We have come to the following conclusions: verification actions have the nature of a criminal procedure; the list of such actions specified in the criminal procedure law is not exhaustive; only those verification actions that are expressly provided for in the law relating to any branch of law and which involve the seizure of material objects can have evidentiary value.
