| In this article, we examine some problems of ensuring individual rights when inflicting a judicial penalty as a criminal-law measure. The author draws attention to the growing competition between the grounds for termination of criminal prosecution, the legislator's errors in the use of legal terminology, the growing imbalance in the legal status of the victim and the accused. |
