We consider some theoretical and applied issues in the study of the problems facing the investigative bodies when obtaining samples for comparative studies. The possibility of obtaining samples for comparative studies by investigators, as well as some controversial aspects of taking them by force are analyzed. In order to overcome this form of coun-teraction, it is proposed to amend the criminal law and criminal procedural legislation regulating the procedure for ob-taining samples for comparative studies that expand the investigator's procedural powers.
