Abstract
One of the requirements of the regime enshrined in Art. 82 of the Criminal Executive Code of the Russian Federation are different conditions of detention depending on the type of correctional institution. This regime requirement is implemented through the institution of changing the conditions of serving the sentence during the term of imprisonment. The penal enforcement legislation provides for four types of conditions of serving the sentence depending on the type of correctional institution: strict, ordinary, relaxed, preferential. Omissions in the application of the institution of changing the conditions of serving sentences lead to some negative consequences, including insufficient achievement of the goal of convicts' correction. In this article, we consider some problems related to the implementation of the institution of changing the conditions of serving the sentence and propose some measures to address these problems.
