In this article, we consider the process of transition of subjective rights into a less stable state - into taxpayers’ legitimate interests. Based on the historical and legal analysis of the development of legislation on taxes and fees, we examine the dialectic of such a transformation, including its prerequisites, causes and consequences. It is concluded that certain rights of the taxpayer are de facto his legitimate interests rather than rights, and such interests have an evidentiary form of realization.
