The article is devoted to the analysis of the origin, development and modern use of the trust, one of the original institutions of Anglo-Saxon law and its connection with fideicommissum, a similar institution of Roman-German law. The phenomenon of the law of justice is investigated, as well as the question of the breadth of judicial discretion in the court process in the form of equity. Legal formulas of the trust, as well as features of its creation in different periods and the order of its functioning are considered. The relevance of the problem is due to the expanding use of the trust in modern civil private law.
