The article examines the genesis, current situation and prospects for the development of legal regulation of the powers of the prosecutor's office in administrative cases. The forms of the prosecutor’s participation are analyzed. Special attention is given to the problems of securing the powers of the prosecutor in the Administrative Code of the Russian Federation, legal uncertainty when presenting the prosecutor’s opinion on the case, and cases of mandatory participation of the prosecutor in the proceedings in administrative cases. The authors formulate their conclusions and some proposals for improving administrative legislation.
