| Based on the author`s model of a triad of legal facts, this paper examines some problems of termination of powers through disqualification. It is proposed to adopt disqualification for breaching of duty of care and to strengthen private law consequences. In the author's opinion, the public credibility of the register of disqualified persons will contribute to enhancing the effectiveness of disqualification. |
