The characteristic of the model of legal regulation of the digital economy in Russia is given. Proposals are formulated for the development of the civil regulation of services in the digital economy in terms of the ratio of imperative and positive principles. The center of regulation of services in the digital economy will shift from the state to large professional market players. It is necessary to maximize the use of the general permission approach, which allows new services to remain in the legal field in the absence of their regulation, as well as the dispositive one (avoiding permanent changes in legislation).
