The article is devoted to the study of issues related to the current state and prospects of development of legislation on transplantation of human organs and (or) tissues as a type of high-tech medical care in the Russian Federation. The analysis of the current legislation in the field of human organ and / or tissue transplantation is made, as well as the problems of legal regulation, in particular the presumption of consent, is identified. A special place in the article is devoted to the implementation of the departmental target program «Organ donation and transplantation», as a new stage in the development of medical care by transplantation in the Russian Federation.
