Public relations and the functioning conditions of the Russian economy recognize the institution of intellectual property, which is protected by the regulatory framework. Intellectual property around the world is one of the most important elements of sustainable development, therefore, the problematics of its legal regulation cannot be exhausted. The main law protecting intellectual property in the domestic legal environment is the Constitution of the Russian Federation, adopted at a nationwide referendum of 1993. The article examines the issues of intellectual activity and their position from the perspective of domestic constitutional law. For this purpose, it is suggested to consider the current situation in intellectual property law, identify problem areas and suggest further trends. It is important to take into account the unstable circumstances in the political and economic sphere, as well as assess the impact of the 2020 amendments in the Constitution of the Russian Federation on the institution of intellectual property. The authors highlighted the problem areas of the legislative basis on intellectual property issues and the directions for further research development in order to improve the compliance of the legislation with the needs of modern society .
