The article discusses the basic principles that operate in the field of exempting a person from administrative responsibility. The author using the international law with its system-forming function for this interdisciplinary study, shows how the European Court of Human Rights interprets the principles of law such as legality, purpose and necessity when analyzing the conditions of admissibility of restrictions on freedom and shows the possibility of applying this interpretation of principles, regarding the institution of exemption from administrative responsibility.
