Abstract
The article presents the results of a comparative analysis concerning the regulation of family relations on the norma- tive monuments of the Frankish state and Ancient Rus. The main principles and approaches of such analysis are defined. Based on the comparison of the monuments of secular and Church law («Lex Salica» and «Russian Truth», Carolingian capitularies and Church charters of ancient Russian princes, regulations confessional practices, etc.) identified common features and specificity in approaches of Church and state to regulate marriage, divorce, intrafamily relations on the example of two States and societies of the early middle ages. The role of traditions of such regulation based on custom- ary law is shown, and the strengthening of the church's position in influencing family relations in order to form a new Christian family ethics is noted (with certain differences in the canonical approaches of the Western and Eastern Chris- tian churches). The obtained experience of comparative analysis allows us to determine the prospects for its application by expanding the chronological and regional framework, as well as attracting new historical sources.
