He article is devoted to the study of the constitutional and legal prerequisites for the formation of the mechanism of administrative and legal regulation in the field of training scientific and pedagogical personnel. The purpose of the article is to identify the constitutional and legal norms on which public administration in the fields of science and higher education is based, and to correlate with them the existing practice of legislative regulation of the training of highly qualified scientific and pedagogical personnel. The goal was achieved using general scientific methods (analysis, synthesis, dialectical method) and the formal legal method. Analyzing the content of legal literature, current and expired legislation, strategic planning documents in the field of science and higher education, the author came to the conclusion that organizational legal relations in the field of training scientific, pedagogical and scientific personnel should be regulated by a single legislation. At the same time, the legislator must take into account the constitutional requirements concerning the implementation of individual rights and the organization of public administration in the fields of science and higher education.
