The article analyzes the provisions of international norms and Russian legislation on the status of the prosecutor as a participant in civil, administrative and arbitration proceedings. The authors pay special attention to the study of the state of such prosecutorial activity in the context of maintaining a balance of private and public interest.The modern role of the institution of the prosecutor's participation in legal proceedings outside the criminal legal sphere is determined by the increased attention of the state and the prosecutor's office to the protection of the constitutional rights and freedoms of citizens, and first of all those who, for health reasons or other valid reasons, cannot effectively carry out such protection on their own. The fact that prosecutors have the authority to go to court in situations where the interests of the Russian Federation, its subjects, as well as municipalities require protection further increases the importance of prosecutorial activity in the relevant types of legal proceedings.
