The purpose of the article is to identify the problems of legal regulation of criminal legal relations functioning during the execution of criminal penalties against military personnel, and to formulate proposals for their solution. The validity and reliability of the formulated conclusions presented in the article is evidenced by the fact that they are based on selected research methods, including the dialectical method of cognition, logical, formal legal, systemic and comparative legal methods.In the course of the research, the author comes to the conclusion that for the timely formation, systematic development and timely termination of the legal relations under study, it is necessary to submit in a new edition Articles 51, 80, 81 of the Criminal Code of the Russian Federation, Part 1 of Article 174 of the Criminal Code of the Russian Federation.
