The article reveals the issues of the court's participation in disciplinary proceedings against lawyers for the first time. Problematic issues of a disciplinary dispute in which the court acts as one of the parties are identified. The authors come to the conclusion that a court ruling is a reason for initiating disciplinary proceedings, and cannot be considered as an unconditional basis for bringing a lawyer to disciplinary responsibility. The court, as a participant in disciplinary proceedings, must justify the violations identified by it.
