The article examines some issues related to the establishment of the subjective side of the crime under Article 330 of the Criminal Code of the Russian Federation. The features of mandatory and optional features, which together form the subjective side of arbitrariness, are considered. The specifics of the definition of these signs, the form of guilt and types of intent when committing arbitrary actions are highlighted. Attention is drawn to the importance of optional signs of the subjective side for the correct qualification of arbitrariness, as well as the possibility of its differentiation from related crimes. The study of the elements of the subjective side helped to establish that crimes are committed with direct and indirect intent. It is established that when committing self-directed actions, there is no selfish motive and purpose.
