Abstract
The paper focuses on some problems related to constitutional regulation of the freedom of economic activity. The author argues that the freedom of economic activity consists, above all, in subordination of the economy to the democratic government, freedom of market and entrepreneurship, private economic initiative, the recognition of independence and equality of economic entities, and support for competition. The concept of freedom of economic activity does not deny the need for balance between state intervention and private enterprise, but gives priority to private enterprise; it comes from the necessity of social partnership, but gives preference to a more active support to the interests of businessmen than other economic actors; it recognizes the responsibility of business to society, but prevents the interpretation of this responsibility in the context of the actual loss of its freedom.
