The article investigates the relationship between the constitutional freedom of teaching and creative work with other constitutional rights and freedoms of man and citizen. The author argues that the State in a democratic society and under the constitutional organization of power should prefer the form of professional self-government to direct state control of higher education. The legal sense of Part 1 of Article 44 of the Constitution of the Russian Federation implies that the legislator and courts should proceed from the presumption of good faith of educational organizations and their faculty, appropriate quality of educational services provided by them unless otherwise proven in corresponding legal proceedings.
