This article discusses the issues of indemnification by the State for damage caused by illegal (unfounded) criminal charges. In practice, it is difficult to completely eliminate cases of unjustified criminal prosecution of citizens. The existing international and domestic legislation has established a mechanism for implementing criminal procedural safeguards in criminal prosecution. We discuss the ways for developing this mechanism as well as some problems encountered in its implementation. |
