| The article deals with the problem of the legal qualification as a fraud of an insolvent debtor's actions when he/she refuses to accept the inheritance. The author concludes that the actions of an insolvent heir who refuses to accept the inheritance should be recognized as an abuse of the right if the heir by his/her refusal harmed anyone's interests (the interests of the creditors). Protection of creditors' rights must be carried out under Article 10 of the Civil Code of the Russian Federation. |
